Tucson Arizona Aggravated DUI

Aggravated DUI “Felony DUI” (ARS 18-1383)

Most aggravated DUIs are class 4 felonies.  Aggravated DUI is charged as a class 4 felony if you drove or had actual physical control of a vehicle while impaired by alcohol or drugs to the slightest degree or with a BAC (blood alcohol concentration) above .08 while,

  1. Having a suspended, cancelled, revoked, refused, or restricted license; or
  2. Having two prior DUI convictions within seven years of the current DUI charge; or
  3. While ordered to have an Ignition Interlock Device on a vehicle.

Aggravated DUI is charged as a class 6 felony if you drove or had actual physical control of a vehicle while impaired to the slightest degree by alcohol or drugs or with a BAC (blood alcohol content) above .08, while having a child under the age of 15 in the vehicle.

Aggravated DUI 1st Offense (Class 4 Felony)

Sentence

Jail/Prison:

4 months – 3.75 years (prison)

Driving Privileges:

3 year revocation

2 year Ignition Interlock Device

Fines and Assessments:

$4500 (approximate minimum) fines and fees

Other Requirements:

Supervised probation

Alcohol screening and classes

SR22 high risk insurance

Possible community service

 

Aggravated DUI, Second Felony (Class 4 Felony)

Sentence

Jail/Prison:

2.25 years – 7.5 years (prison)

3 year revocation

Supervised probation
